At the same time, the Newton Police Department, IA produces mountains of evidence of an unreasonable and inconsistent delay in producing public records documenting their historical actions that are outside the timeframes articulated in Iowa Code Section 22.8(4.)(d.).

The following are paragraphs 4 – 6 from Iowa Incident Report 22-25845:

“Tayvin reached over to the glove box, where he retrieved some paper work. While he did so, I noticed that he moved slowly. While Tayvin was trying to find his registration, he was moving slowly, he had the correct registration in his left hand and he continued to move slowly. While I was waiting for his insurance, Tayvin grabbed a debit card out of his billfold. He then placed this back and then gave his license. Tayvin then grabbed the registration again and then looked at it and then placed it back into the glove box. At this point I had still not received the insurance card. Tayvin continued to sit in the drivers seat with no insurance. I had to remind him again for his insurance.

As I was waiting for Tayvin to give me his insurance card, I noticed that he continued to move slowly. Tayvin then provided me an insurance card that was expired from 2021. He then stated I have the email version. As Tayvin started to look in his phone for his insurance, he continued to move slowly thumbing through items on his phone where he finally was able to find the insurance. I advised Tayvin that I wanted him to exit his vehicle. I told him to take his gum out of his mouth and place it on his dash. He did so without incident.”

The following is a dramatized recreation of events during 2022 and 2023 regarding the City of Newton, Iowa – Government response to record requests in accordance with Iowa Code Chapter 22. Although there are fictional aspects of this for the purpose of making a comedic point at the same time maintaining continuity with the referenced abortion of a police report. Public records are available from the City of Newton, IA, the Iowa Public Information Board, and the author of this post upon request reinforcing the overall narrative of the below dialog.

Rob continued to sit at his desk while failing to provide all of the requested public records or filing an injunction request with the Iowa Court to withhold the requested records in accordance with Iowa Code Section 22.8(4.)(a.) and 22.8(4.)(d.). I had to remind him again for the requested public records.

As I was waiting for Rob to give me the requested public records, I noticed that he continued to move slowly. Rob then provided me a public record and articulated it was an Iowa Incident Report. At the same time, the evidence indicated it was a warrant request filed with the Iowa Court in 2020. He then stated I am no longer allowed to send my record requests via email version. As Rob started to look in his phone for his public records, he continued to move slowly thumbing through items on his phone where he finally was able to find another public record that did not produce a criminal charge that was heavily redacted. I advised Rob that I wanted him to exit his vehicle. I told him to take his badge off of his uniform and place it on his dash. He did so without incident.

Chief Burdess, as you have produced evidence similar to a citizen that you attempted to charge with a crime based upon evidence of moving slowly.
